These Terms and Conditions (“Terms”) are a binding agreement between you (“you”, “your”, or “User”) and TaiyariPoint (“TaiyariPoint”, “we”, “us”, or “our”). By accessing or using the TaiyariPoint website, mobile application, APIs, products, or services (the “Platform”), you agree to be bound by these Terms and our Privacy Policy, available at /privacy (the “Privacy Policy”), which is incorporated by reference. If you do not agree to these Terms, do not access or use the Platform.

1. Definitions

  • 1.1 “Account” means a registered user account on the Platform.
  • 1.2 “Content” means any materials on the Platform including but not limited to mock tests, questions, answers, solutions, explanations, images, videos, articles, and learning resources.
  • 1.3 “User Content” means any content submitted, posted, uploaded, or otherwise provided by Users (e.g., comments, reviews, uploads).
  • 1.4 “Paid Services” means any service, subscription, test series or product for which Users are charged a fee.

2. Eligibility

  • 2.1 You must be at least 16 years old to use the Platform. By using the Platform you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into this agreement. If you are under 18, you must use the Platform only with parental/guardian consent.
  • 2.2 You must provide accurate, up-to-date information during registration and promptly update such information if it changes.

3. Account & Security

  • 3.1 Account registration requires a valid email and password. You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your Account.
  • 3.2 You agree to notify us immediately of any unauthorized use or security breach. We are not liable for losses arising from unauthorized use of your Account unless caused by our gross negligence.
  • 3.3 You may not create multiple accounts for the purpose of abusing promotions, free trials, or circumventing bans. We may require identity verification and may suspend or terminate Accounts that appear fraudulent.

4. User Conduct — Prohibited Activities

  • Use the Platform for any unlawful purpose or in violation of applicable laws.
  • Upload, share, or distribute exam papers, copyrighted test content, or any proprietary materials that you do not have the right to share.
  • Copy, reproduce, distribute, sell, rent, sublicense, or publicly display Content other than permitted by these Terms.
  • Use bots, scrapers, crawlers, or other automated means to access or collect data from the Platform.
  • Reverse engineer, decompile, tamper with, or attempt to derive the source code of the Platform.
  • Interfere with the operation of the Platform (e.g., attacks, spam, DDoS).
  • Provide false or misleading information, commit payment fraud or initiate chargebacks without cause.
  • Post abusive, harassing, defamatory or obscene material.

Violation may result in suspension, termination, legal action, and recovery of damages.

5. Intellectual Property & License

  • 5.1 All Content and Platform technology are owned or licensed by TaiyariPoint and protected by copyright, trademark, and other laws.
  • 5.2 Subject to your compliance with these Terms, TaiyariPoint grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial exam preparation.
  • 5.3 Except for the limited license above, no rights, title or interest in the Platform or Content are transferred to you.
  • 5.4 You may not remove or alter any proprietary notices on the Platform or Content.

6. User Content; License to TaiyariPoint

  • 6.1 By submitting User Content to the Platform, you represent and warrant you have all rights necessary to grant the below license.
  • 6.2 You grant TaiyariPoint a worldwide, royalty-free, transferable, sublicensable, perpetual, irrevocable license to use, reproduce, modify, publish, translate, distribute, perform, display, and create derivative works from User Content for the purposes of operating, promoting, and improving the Platform.
  • 6.3 We may remove or refuse to publish any User Content that violates these Terms or is otherwise objectionable, at our discretion.

7. Paid Services, Billing, and Refunds

  • 7.1 Payment processing is handled by third-party payment processors; you authorize them and us to charge your chosen payment method. We do not store full payment card details unless explicitly disclosed.
  • 7.2 Prices shown are exclusive of applicable taxes (GST/VAT) unless stated. You are responsible for any applicable taxes.
  • 7.3 Refund Policy: We will consider refunds only in the following cases: (a) duplicate payments; (b) verified technical failures preventing you from using the Paid Service (and only if reported within 7 days of purchase and after you have allowed us reasonable time to fix the issue); or (c) as required by applicable consumer law. Requests must be submitted to support@taiyaripoint.com with transaction details and supporting evidence. Refunds are subject to our verification and may be refused if we reasonably believe there is abuse or fraud.
  • 7.4 Chargebacks: If you initiate a chargeback without contacting us first, we may suspend or terminate your Account, refuse future purchases, and pursue recovery of amounts owed. We may also provide information to payment processors to dispute chargebacks.

8. Free Trials, Promotions and Coupons

  • 8.1 Trial offers or coupons are subject to specific terms and may be limited to one per user. We reserve the right to modify, cancel, or revoke any promotional offer at our discretion. Fraudulent or abusive use of trial offers will lead to termination and recovery of benefits.

9. Content Accuracy, Educational Disclaimer & No Guarantee

  • 9.1 We strive to provide accurate and up-to-date educational content, but we do not guarantee the completeness, accuracy, or suitability of Content for any specific exam or result.
  • 9.2 No Guarantee of Exam Outcomes: Use of the Platform does not guarantee passing any exam or achieving any particular score.
  • 9.3 Content is provided “AS IS” and for educational purposes only. You are responsible for verifying facts required for exam participation.

10. Privacy, Data Retention & Deletion

  • 10.1 Use of personal data is governed by our Privacy Policy. By using the Platform you consent to such collection and use.
  • 10.2 We retain data as necessary for business purposes and to comply with law. You may request deletion or correction of your personal data via support@taiyaripoint.com. We may retain anonymized or backup copies as required by law or legitimate business interests.
  • 10.3 You acknowledge that certain data (e.g., transactional records, tax-related records) may need to be retained for statutory periods.

11. Communications & Notices

  • 11.1 We may send notices by email or by posting on the Platform. You agree notices sent to the email on your Account are effective.
  • 11.2 Legal notices should be sent to support@taiyaripoint.com (or to our registered office address where provided).

12. Third-Party Services & Links

  • 12.1 The Platform may contain links to third-party websites, services or resources. We do not endorse and are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.

13. Security

  • 13.1 We use commercially reasonable measures to protect your data. You are responsible for maintaining the security of your Account and for all activity that occurs under your Account.
  • 13.2 We will notify you of any confirmed data breach affecting personal data when required by law.

14. Suspension, Termination & Account Recovery

  • 14.1 We may suspend, restrict or terminate access to the Platform or delete Accounts if we reasonably suspect: (a) breach of these Terms; (b) fraud or misuse; (c) illegal activity; or (d) at our discretion for business reasons.
  • 14.2 On termination, your right to use the Platform ceases. We may preserve records as necessary for legal compliance.
  • 14.3 You may request account deletion; where deletion is possible, we will comply subject to data retention rules and our ability to continue providing services (e.g., outstanding refunds, fraud investigations). Contact support@taiyaripoint.com.

15. DMCA / Copyright Infringement & Prohibited Content

  • 15.1 If you believe Content on the Platform infringes your intellectual property rights, contact support@taiyaripoint.com providing: identification of the copyrighted work, infringing URL(s), a signed statement of good faith, and contact info. We will take action including removal where appropriate.
  • 15.2 Repeat infringers’ Accounts will be terminated. We reserve the right to defend against frivolous or fraudulent claims.

16. Indemnity

You agree to indemnify, defend and hold harmless TaiyariPoint, its affiliates, officers, directors, employees and agents from and against any losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of law; (c) your User Content; or (d) your misuse of the Platform.

17. Disclaimers & Limitation of Liability

  • 17.1 Disclaimer: Except as required by applicable law, the Platform and all Content are provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
  • 17.2 Limitation of Liability: To the maximum extent permitted by law, TaiyariPoint’s aggregate liability for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amounts you paid to TaiyariPoint in the 12 months immediately preceding the event giving rise to liability, or INR 10,000 (ten thousand Indian Rupees), whichever is greater. In no event will TaiyariPoint be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, loss of data, or business interruption, even if advised of the possibility of such damages.
  • 17.3 These limitations apply even if a remedy fails of its essential purpose.

18. Governing Law & Dispute Resolution

  • 18.1 These Terms are governed by the laws of India. The courts of Jaipur, Rajasthan shall have exclusive jurisdiction over disputes arising out of or related to these Terms.
  • 18.2 You and TaiyariPoint will attempt to resolve disputes informally by contacting support@taiyaripoint.com. Nothing in this clause prevents TaiyariPoint from seeking injunctive relief or other equitable remedies.

19. Force Majeure

TaiyariPoint will not be liable for delays or failures in performance resulting from acts beyond its reasonable control, including pandemics, strikes, natural disasters, outages, internet failures, or government actions.

20. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or by prominent notice on the Platform at least 30 days before the new Terms become effective. Continued use after the effective date constitutes acceptance of the updated Terms.

21. Severability; Waiver; Assignment; Entire Agreement

  • 21.1 If any provision of these Terms is held unenforceable, the remainder will remain in effect.
  • 21.2 Failure to enforce any provision is not a waiver.
  • 21.3 You may not assign your rights under these Terms. TaiyariPoint may assign these Terms or transfer rights without user consent.
  • 21.4 These Terms and the Privacy Policy constitute the entire agreement between you and TaiyariPoint regarding the Platform.

23. Miscellaneous — Additional Protections (Practical Notes)

  • We reserve the right to block IPs or geographic regions if abuse is detected.
  • We may require identity verification for certain purchases or refunds.
  • If we suspect exam paper leakage or content theft, we will cooperate with law enforcement and pursue civil remedies.
  • Paid Content may be watermarked to deter redistribution.
